Where Smoking is Banned><span>>
All private worksites including the following areas:<
em>><p>- Restrooms, lobbies, reception areas, hallways, all common- use areas
- Waiting rooms, hallways, health care facilities, hospitals, clinics, doctor, dentist and any other health care office
- Buses, taxicabs and all forms of public transportation
- Places of public service such as: service lines, retail stores, laundromats, attorneys' offices, other offices, nonprofit organizations, banks, hotels and motels
- Any public place of meeting or assembly
- Lobbies, hallways, and other common areas of apartment buildings, condominiums, trailer parks, retirement facilities, nursing homes, and other multi-unit residential facility
>Smoking is banned in all recreation areas.<em>
- Galleries, libraries, museums and indoor performance areas
- Enclosed recreation areas such as: sports arenas, convention halls, public and private meeting facilities, hotel meeting facilities when used to serve the public
>Smoking would be allowed in a private workplace if:<em>><p>
- A smoking break room is designated that is separately enclosed, separately ventilated and a nonsmoking break room is also designated. Additional provisions also apply.
Where smoking would be allowed:>>
- Tobacco specialty stores
- Private Residence
- A private worksite that chooses to create a separate room that is enclosed and separately ventilated
- Bingo Halls
- Hotel and motel meeting rooms when these areas are enclosed and used for private functions (i.e. private party)
- "Food Service Establishments"- Restaurants and Bars><span>
>Maintaining a Smokefree Policy<strong>><p>
- This regulation goes into effect Monday, August 12, 2002. At this time employers that are not currently smokefree, must post no smoking signs at each main entrance and establish a smokefree policy which they distribute to each employee by the date of July 21, 2002. A business that does not currently have a smokefree policy, shall write a policy that contains the following:
>Smoking is prohibited in all enclosed areas within this worksite. This includes common work areas, auditoriums, classrooms, conference and meeting rooms, private offices, elevators, hallways, medical facilities, cafeterias, employee lounges, stairs, restrooms, vehicles, and all other enclosed facilities.<em>

- The Health Department will investigate citizen complaints<span>
- An employee wishing to file a complaint shall first exhaust all internal complaint procedures
- Persons found in violation shall be guilty of an infraction punishable by a warning followed by progressive fines
- Warnings and fines will be issued to the owner of the property when infractions are found
- This regulation protects against retaliation
